5.1 - Barred Offenses

The certification worker may not grant certification to an individual if the provider or non-client resident has an offense that bars the person from being a caregiver, employee, or a resident of a certified home. In the barred cases, the basis for the revocation is Wis. Stats. 48.686.

 

Even when the revocation is due to a barred offense, and the CBU has issued an ineligible determination, the operator must be informed of the decision to revoke the certification in writing. The certification agency must inform the operator in writing of the operator’s right to appeal the decision and the agency’s steps in the appeal process.
