Child Care Certification Policy Manual
The certification worker shall prepare and send written notice of suspension to the operator. The notice shall provide the grounds for the suspension and explanation of the process for appealing the action. It is important the suspension notice:
Clearly articulates the reason(s) for the suspension.
Identifies all relevant statute and/or rule citations.
Accurately and concisely documents facts related to the noncompliance(s), if applicable.
Informs the operator of the time-frame / deadline for correction, if applicable, and any potential next action / sanction if not met*;
Includes information regarding the operator’s right to appeal.
Note: The notice must be uploaded in the Enforcements Module – Documents (unless it contains confidential information).
Suspensions, even those due to the background check law, are subject to appeal through an administrative hearing as provided for in Chapter 68 (Milwaukee certification ch. 227). It is important to keep in mind that should the suspension be appealed, the notice of suspension will become an important reference document in preparing for the administrative hearing.
Although sanctions/enforcements shall be documented using the Enforcement Module in WISCCRS, it is critical that the certification worker change the operator’s category status in WISCCRS accordingly. Example: A certified operator is suspended on 3/4/15. At that time the category status in WISCCRS should be changed to a “suspended” with an end date of 3/4/15. In addition, the certification worker must enter the suspension in the Enforcement Module.
