2.2 - Substantially Related Offenses

If the CBU issues an ineligible determination for an applicant or household member due substantial relatedness of one of the non-serious offenses enumerated in s. 48.686, the agency denies the application for certification once the background check determination appeal timeline has been exhausted. If the CBU determines the applicant/individual is eligible the certification agency may still choose to deny an application due to background check results. Certification agencies have authority and responsibility for making “fit and qualified” determinations under DCF 202.06(1)(h) and regulatory decisions under DCF 202.06.
