If a rule violation related to the complaint allegation is substantiated, subsequent action must be taken. Issuing a 294 (Noncompliance Statement) as a result of a complaint investigation is similar to issuing 294s that result from regular monitoring. See the WISCCRS User Guide – Complaints/Incidents for instruction on attaching violations to a complaint.
Depending on the finding, the certification worker must assess whether monitoring should be increased, citation(s) (noncompliance statement) should be issued and / or further sanctions should be taken. Things to consider are:
Does the compliance history suggest a pattern of similar violations in previous monitoring visits or complaint investigations?
Is the level of risk such that it is safe to rely on routine corrective action to restore timely compliance with the rules?
Should special conditions be placed on the certification?
Is a warning letter or suspension needed in order to ensure immediate and continued compliance?
Is it necessary to take a stronger sanction, such as revocation or denial of the renewal application?
