Child Care Certification Policy Manual
The Biennial Budget Act (2009 Wisconsin Act 28) made automobile liability insurance mandatory in Wisconsin effective June 1, 2010. This law states that no person may operate a motor vehicle upon a highway in this state unless the person, while operating the vehicle, has in his or her immediate possession proof that he/she is in compliance with the requirement to have liability coverage. The law set mandatory minimum amounts of required insurance. Then in 2011, the provisions regarding the amount of liability insurance required were modified in 2011 Wisconsin Act 14. This new law and minimum requirements applies to all regulated child care providers who transport children.
DCF 202.08(9)(i) The operator shall obtain and maintain vehicle liability insurance with minimums no less than those specified in subch. VI. of ch. 344 Stats. The operator shall maintain proof of insurance and make this information available to the certification worker upon request.
Minimum requirements:
$25,000 for personal injury
$50,000 for death
$10,000 for property damage

Certification workers may require the applicant/operator submit documentation of insurance, and this information may be uploaded into WISCCRS. The certification worker may choose to review verification of insurance during a site visit, and document the review on the standards and checklist.
