Information the agency received from the FBI (fingerprint-based background check results) prior to 10/1/18, shall only be used for the purpose specified under the applicable state or federal law under which access to this information was granted. Re-dissemination of criminal history record information acquired under the agreement between the agency and the Crime Information Bureau (CIB) are strictly prohibited. However, the subject of the record search may request a copy of the result / record.
Certification agencies determine where to store/retain the agency-conducted fingerprint-based background check results received prior to 10/1/18. Because operator files contain confidential information it is assumed the certification agency has records management policies in place and that hard copy files/records are maintained in a secure but accessible (to authorized personnel) records environment.
When the fingerprint-based background check hard copy record is no longer needed the record must be disposed of in such a way the information contained in the record cannot be retrieved.
