Child Care Administrative Rule Updates

The primary purpose of the proposed rule change is to ensure that the department’s rules affecting child care certification and licensing comply with the health and safety requirements in federal regulations based on the Child Care Development Block Grant (CCDBG) Act of 2014. The proposed rule changes incorporate new federal background check requirements into child care administrative rules (202, 250, 251, 252) and create DCF 13 as a new child care background check administrative rule in accordance with Wis. Statute 48.686. The proposed rules also regroup the department’s child care certification and licensing rules that address the same topics in different places, eliminate duplicative provisions, correct errors, and clarify language where needed to ensure proper implementation and administration of the health and safety requirements.

Hearing Notice

Public Hearing: The Department of Children and Families (DCF) welcomes input from stakeholders and the public. Comments are voluntary and DCF will report to the Legislature a summary of all comments received, the department’s response to those comments and an explanation of any modification made to the proposed rule(s) as a result of comments or testimony received at the public hearing. Personal information may be provided to requestors to the extent required by Wisconsin Open Record Laws (Wis. Stat. §§ 19.31-19.39).
