Rationale for Reasonable Suspicion of Program Violation:

The Department gave the provider an opportunity to provide a satisfactory explanation to the Department on 4/3/2012; the provider failed to attend the in person meeting. The Department is revoking all child care authorizations and refusing to issue payments based upon a combination of red flags indicating a likelihood of Shares violations and the following findings from the Department’s investigation including: 1) the provider’s failure to comply with the provisions of the stipulation the provider signed with the Department; 2) the provider’s failure to maintain and submit accurate attendance records as required by the Shares program; and 3) the provider’s failure to comply with the statutes, promulgated rules, or policies of the Wisconsin Shares program.

The Department has evidence that the provider:

  • Billed for more hours than children actually attended.
  • Billed for children no longer attending the provider’s child care center.
  • Billed for children who were not in attendance.

The provider entered into a signed stipulation with the Department on 4/2/2010. As a condition of continued participation in the Wisconsin Shares program, the provider stipulated that all sign-in/sign-out sheets would by signed by the child’s parent. Contrary to the requirement of the stipulation, the Department has evidence that the parents did not actually sign the attendance records. Rather, the provider signed the parent’s names to the attendance records. This is a violation of the 4/2/10 stipulation.
