Enactment of Act 2, Relinquishing Custody of a
Newborn Child |
The Governor recently signed into law 2001 Wisconsin Act 2 (Assembly
Bill 54). This new law allows parents to anonymously relinquish custody of
a newborn who is less than 72 hours old. The infant may be turned over to
a law enforcement officer, an emergency medical technician, or a hospital
staff member, who subsequently must turn the child over to a court intake
worker.
The law grants rule-making authority to the Department of Health and
Family Services. We are currently in the process of developing that
administrative rule. We will keep you informed as that rule process moves
forward.
