Re: Wisconsin Act 308

This is to notify you that Wisconsin Act 308 requires the Department to determine if there has been a substantiated report of abuse or neglect by adoptive parent(s) when they request an amendment to their adoption assistance agreement. Secretary Leean recently signed the emergency administrative rule that implements Act 308 and the emergency rule was published on November 16th. The rule language amends HFS 50, the Department's rule for facilitating the adoption of children with special needs.

County Protective Services Units will be contacted by Jill Duerst, Adoption Assistance Program Coordinator in the Bureau of Programs and Policies, to request verification of abuse or neglect information for specified individuals who are eligible for an adoption assistance amendment. A copy of the request format is attached. It is important that a prompt response be received to these requests.

If you or your staff have any questions, please contact Jill at (608) 266-1142. Your cooperation in implementation of this legislation is greatly appreciated.
