Eligibility and Reimbursibility Overview

 

Title IV-E Eligibility:  Initial IV-E eligibility is determined based on information when the child is initially removed from his or her home, and the child welfare agency obtains legal responsibility for the child. Once a child is determined initially eligible, IV-E eligibility must be redetermined annually for the child over the duration of the out-of-home care episode.

If a child is determined not eligible, then the child is IV-E ineligible for the duration of the out-of-home care episode. If a child returns home for more than 6 months or if the agency’s legal responsibility ends while the child is home, a new episode begins when the child re-enters out-of-home care and a new IV-E eligibility determination must be conducted.

Title IV-E Reimbursibility:  The child must be determined IV-E eligible and reimbursable for the state to claim IV-E reimbursement for the maintenance costs of the child. The agency managing the child’s case and the court must meet certain IV-E procedural requirements for the child to be reimbursable. The child’s placement must be with a reimbursable provider or facility to claim IV-E reimbursement. The care provider must also be licensed in a timely manner for the child’s maintenance costs to be reimbursable.
